D.C.'s Budget Hostages and Congress E-mail

On April 5, 2011, the Washington Post editorial board published an editorial, entitled "D.C.'s budget hostages," on whether home rule and key D.C. programs will become bargaining chips in the effort by Republicans and Democrats in Congress to approve a federal budget for fiscal year 2011. Over half way through the fiscal year, Congress has not approved ANY agency budget or the D.C. budget. Because Congress must approve the District of Columbia's budget and "no amount may be obligated or expended by any officer or employee of the District of Columbia government unless such amount has been approved by Act of Congress, and then only according to such Act" (D.C. ST § 1-204.46), if the budget impasse continues and there is no continuing resolution, then BOTH the federal AND the District of Columbia governments will have to shut down.  D.C., because it is not a state, is the ONLY state or local government that cannot spend its own tax money without Congressional approval.

How will a federal government shutdown affect D.C.? E-mail

Washington Post reporter Mike DeBonis wrote in a February 23, 2011 column that because Congress has not done its job and approved the District of Columbia's fiscal year 2011 budget, which was submitted to it last spring, the District Government may be shut down March 4, 2011 if Congress does not pass another continuing resolution to keep the Federal (and also the D.C.) government funded.

The District's fiscal year 2011 began October 1, 2010, but Congress included its budget in a financial services funding bill that it has not yet approved. As Mayor Gray said in his press conference on February 23, 2011: "The District of Columbia government is treated like another agency of the federal government, which is entirely inappropriate," he said. "There's no way that Cleveland or Detroit or Los Angeles or Boston or anywhere else in this nation is having to have this kind of discussion today."

D.C. Delegate Eleanor Holmes Norton has been trying to get Congress to pass an amendment to a must pass bill that would allow the District government to keep functioning regardless of what Congress does on the Federal budget. Read her press release below.

All Americans should find Congress's dereliction of duty in performing one of its most essential functions to be shameful.  The irony is that the D.C. government performed its budgetary duties promptly and on time, but that District residents will be punished because those elected by the 50 states have again failed to do the same. Only D.C. statehood will put an end to this idiocy.

Congress Threatens D.C. Home Rule E-mail

Washington Post Reporter Mike DeBonis writes on February 8, 2011, about H.R. 3, the "No Taxpayer Funding for Abortions Act" that in addition to restricting Federal funding of abortions would single the District of Columbia out and ban it alone from using its local tax monies to cover these health services for its residents.

The purpose of the bill is to prohibit the use of federal funds on abortions. The bill states ''Nothing in this chapter shall be construed as prohibiting any individual, entity, or State or locality from purchasing separate abortion coverage or health benefits coverage that includes abortion so long as such coverage is paid for entirely using only funds not authorized or appropriated by Federal law." However, while the bill allows states to use state and local tax monies for abortions and related health services, the bill would treat District tax monies as Federal dollars and prohibit D.C. from providing for its residents the same health services that states may provide for their residents. The bottom line is that D.C. is treated as if it were a Federal agency and the rights and health needs of the almost 602,000 D.C. residents are totally ignored.

The language of the section applying to D.C. is as follows.  Note: under D.C.'s limited "home rule," the Council must submit the District's budget to Congress. D.C. does NOT have the power to approve its own budget and way it wants to spend its own local tax money.

SEC. 310. APPLICATION TO DISTRICT OF COLUMBIA.

`In this chapter:

`(1)
Any reference to funds appropriated by Federal law shall be treated as including any amounts within the budget of the District of Columbia that have been approved by Act of Congress pursuant to section 446 of the District of Columbia Home Rule Act (or any applicable successor Federal law).

`(2) The term `Federal Government' includes the government of the District of Columbia.

D.C. Delegate Eleanor Holmes Norton spoke out at a press conference on this bill after she was denied the right to speak at the House Judiciary Subcommittee on the Constitution's hearing on it. If you support marriage equality, work for D.C. statehood! E-mail

The Hill reports on January 25, 2011 that Rep. Jim Jordan (R-OH) and chairman of the Republican Study Committee plans to introduce legislation to overturn the Marriage Equality Act approved last year by the District of Columbia Council. In the last Congress he was the lead sponsor of the D.C. Defense of Marriage Act, which attracted 53 co-sponsors. He also added his name to a legal brief challenging the D.C. Board of Elections and Ethics' denial of a referendum overturning that law.

This is a prime exhibit as to why the 602,000 residents of the District of Columbia need statehood. D.C.'s law on marriage equality survived challenges all the way to Supreme Court, but only in the colony of the District of Columbia can Congress overturn the will of the people. All Americans who are citizens of a state and who care for the human rights of all other Americans should urge their Congressional delegations to support H.R. 265, the New Columbia Admission Act, introduced by Eleanor Holmes Norton on January 12, 2011. D.C. residents should also educate their friends and relatives around the country to do the same.

The GOP's threat to D.C. home rule E-mail

In an editorial in the January 24, 2011 Washington Post, the Post's editors wrote about a possible new threat from the House of Representatives Republican majority to what limited self-government residents of the District of Columbia have.  The editorial notes that "(i)nstead of merely rolling back local laws, the bill would essentially make the government of the District of Columbia part of the federal government for abortion purposes" and that this "would fundamentally reshape the relationship between Washington and the federal government."
